Drone use

At Marimurtra, only professional drones may be used under certain conditions:

  • Have the express permission of the Botanical Garden management. If this authorisation has not been granted, the Carl Faust Foundation reserves the right to take legal action against anyone making unlawful use of its facilities.
  • Provide the official drone pilot licence issued by AESA.
  • Provide proof of holding the corresponding civil liability insurance.

DATA PROTECTION:

Legislation does not allow recording in public spaces where two or more people are present without the corresponding authorisation. At Marimurtra, it is strictly prohibited to operate drones during opening hours and in areas open to the public without accepting the drone use conditions and providing the documentation described in the form below.

Acceptance of the drone use rules at Marimurtra Botanical Garden

I, as a duly accredited drone pilot holding the corresponding official authorisations, declare that I have read and fully understood the drone use rules applicable to the facilities of Marimurtra Botanical Garden.

I undertake to comply with all the conditions set out in this document and accept full responsibility for any breach thereof, releasing the Carl Faust Foundation from any legal or other liability that may arise, particularly those relating to image rights and the protection of property.

Purpose

I declare that I am a properly accredited drone pilot and that this request for authorisation relates to the carrying out of a photographic or audiovisual shoot at Marimurtra Botanical Garden, for which permission has been expressly requested to operate an unmanned aircraft within the Garden facilities.

I undertake to:

  • Provide all required documentation at least 72 hours before the scheduled date of the session.
  • Hold image rights authorisations from all individuals participating in the session.

Pilot commitments

  • Not fly the drone over areas where crowds of people are present (under current legislation, two or more people).
  • Not record images of visitors to Marimurtra Botanical Garden without their prior and explicit consent.

In exceptional cases

If the session takes place in an area that has not been reserved exclusively, I undertake not to capture or retain images of any person unrelated to the photographic session who has not expressly authorised the use of their image rights.

Mandatory documentation

  • Official UAS pilot licence issued by AESA (or the equivalent national authority). The registration certificate alone will not be accepted.
  • Civil liability insurance providing minimum coverage of €1,300,000 for personal injury and property damage.
  • Acceptance of these conditions.
