WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE COOKIES?
The AEPD Guide of July 2023, with the contribution of information and criteria from the European Data Protection Board (EDPB), GDPR-EU-2016/679 (Articles 5, 6, 7, and 13), and LOPDGDD-3/2018 (Article 6), must be interpreted to mean that consent will only be valid if it is explicit.
USER CONSENT:
To process your personal data securely and privately, your consent is required in compliance with GDPR-EU-2016/679, specifically Articles 5, 6, 7, and 13, as well as Title II of LOPDGDD-3/2018. By clicking a “Check or Button” labeled “Accept,” the user of this website/App provides explicit consent for the processing of their data and information collected through cookies stored on their device.
By clicking a “Check or Button” labeled “Reject,” the user denies cookies except for those exempt from the obligation to obtain consent, such as session or first-party cookies.
A “Check or Button” labeled “More Information” will grant access to this Cookie Policy.
Consent for minors:
Article 8 of GDPR-EU-2016/679 outlines the conditions applicable to a child’s consent regarding information society services:
- When Article 6(1)(a) applies, in relation to direct offers to children of information society services, the processing of a child’s personal data is considered lawful if the child is at least 16 years old. If the child is under 16 years of age, such processing is only lawful if consent is provided or authorized by the holder of parental responsibility or guardianship over the child and only to the extent that consent was given or authorized.
- The data controller shall make reasonable efforts to verify, in such cases, that the consent was given or authorized by the holder of parental responsibility or guardianship over the child, considering available technology.
WHAT ARE COOKIES?
Cookies are small data files received on your device from the website you visit, used to record certain interactions during navigation. These files are stored on the user’s device and contain anonymous data that are not harmful. Cookies are used to remember user preferences, such as the selected language, login information, or website/App personalization.
Cookies or storage devices have traditionally been associated with websites. However, they are now used across various platforms and applications (e.g., smartphone and tablet Apps).
Cookies may also record anonymous information about how visitors interact with a site—for instance, from which website/App they accessed it or if they used an advertising “banner.”
Information society services can be provided by the publisher via a platform, application, or website/App accessed from the user’s device.
1. WHY DO WE USE COOKIES?
We use first-party and third-party cookies to analyze website usage and display advertising tailored to preferences based on a user’s browsing profile.
The Carl Faust Private Foundation uses Technical and Analytical Cookies to facilitate secure navigation, provide customized options, and more. These cookies collect usage data to improve services, measure website performance, optimize functionality, and personalize the user experience.
For instance:
• Google Analytics Cookie: Google Analytics is a free service provided by Google Inc. that collects information about visited web pages, access times, web browsers used, etc. This information is then sent to Google Inc.’s servers.
2. HOW DO WE USE DIFFERENT TYPES OF COOKIES?
By purpose:
• Technical Cookies: Enable the user to browse a website, platform, or application and use various options or services. For example, maintaining session integrity, managing response times, ensuring security, and sharing content.
• Preference or Personalization Cookies: Remember information to allow the user to access services with certain features, such as language settings, search preferences, or visual adjustments.
• Analytics or Measurement Cookies: Allow tracking and analysis of user behavior on websites or Apps, including ad impacts. The data collected helps improve services based on user activity.
• Advertising Cookies: Allow administrators or third parties to analyze browsing habits to display ads based on the user’s browsing profile.
By duration:
• Session Cookies: Designed to collect and store data during the user’s session. Typically used for temporary information (e.g., a list of purchased products) and deleted after the session ends.
• Persistent Cookies: Store data on the device and can be accessed for a defined period set by the cookie provider, ranging from minutes to years. Persistent cookies should be minimized when possible to mitigate privacy risks.
Legal obligations related to cookies include transparency and obtaining explicit consent from website users.
Depending on the nature of the business, it’s recommended to review cookies periodically to identify whether they are first-party or third-party, session or persistent, and their specific purposes. Such reviews help determine whether cookies fall within the scope of Article 22.2 of the LSSI and ensure compliance with technological neutrality so that most browsers can recognize these solutions.
3.- LINK FOR COOKIE IDENTIFICATION:
It is advisable that the information through which cookies are managed (including how to revoke consent and delete cookies) is made available in an accessible and permanent manner at all times via the website, application, or online service in question. For these purposes, and without prejudice to other solutions that may be adopted, this requirement shall be considered met if the cookie management system (configuration panel or a CMP, which allows website or App owners to obtain, manage, and disseminate consumer consent) is integrated into the cookie policy itself or when a link is included in this policy that directly leads to the management system or configuration panel.
AEPD Guide, 3.2.10. Possibility of denying access to the service if cookies are rejected:
There may be specific cases where not accepting the use of cookies prevents access to the website or the total or partial use of the service, provided that the user is adequately informed about it and an alternative is offered, not necessarily free of charge, to access the service without accepting the use of cookies.
These cookies must comply with GDPR-EU-2016/679, LOPDGDD-3/2018, the LSSI-CE-34/2002 regulations as updated on 09/05/2023, and the AEPD Cookie Use Guide of July 2023, with criteria from the EDPB.
